I am happy to write that today I received my first emailed receipt notice for a FY 2010 H-1B application and that then, about 5 hours later, I received an emailed approval notice in the same case. The I-129 was a U.S. Masters Cap case that was premiumed processed with the Vermont Service Center.
I will update this site as I receive word on my other FY 2010 H-1B cap cases.

Hi,
My Priority date is Jun 2006/EB2 India. After the Aug bulletin I'm now afraid that my priority date might get current next month.
My concern is that I might be getting married in the near future and I don't want to deal with an immigration nightmare for my spouse. At the same time I don't want to rush a decision like getting married based on USCIS priority dates. Is there anyway I could delay my GC adjudication for 3-4 months to get some more time ...

I have an H1B approval from USCIS, and I am trying to go to Canada for the initial visa stamping. But then i have a problem. I initially entered the country as a visitor, and married a citizen, but only after my I-94 had expired for about a week. (My petition is still pending. The company I am working for could not wait for my greencard, since its already been years since I started that process, so they went ahead and applied for the H1B visa for me). I heard that it is a problem to do the visa stamping in Canada if you have been out of status before. Is it advisable to go to Canada for the visa stamping?

I am on my 7th year of H-1B (not stamped) and H-1B is due to expire in 2011. I am with the same employer since beginning of H-1B. My AOS is pending and have received AP and EAD.
I am planning to visit Canada next month and want to enter USA with the help of AP. My question is Can I continue my salary using H-1B with the same employer? I read somewhere that I can use my H-1B for salary processing in such circumstances provided I am working for same employer.

What is the point of publishing dates for people to see if they have no relevance?
If they are just for CIS employees to see... why publish them publicly and confuse the deuce out of the entire immigrant community?
If they are "a statement of goals", why aren't these goals being adhered to?
Why set and publish goals that are are not followed?

Thanks for poiintiing this out. Pls try to find others like you stuck in retrogression from yoiur state/company. You can build a state chapter in your state and help organize activities.

File your EAD based on where you live - it does not matter where you 485 is being processed.

My I-140 got approved and priority date from EB3 got ported to EB2. I read in one of the forum threads that USCIS system would automatically identify that application is current and appropriate action will be taken. Also, I read about initiating interfile process of existing EB2 I-140 (current) with Pending I-485 application (under EB3). I am not sure whether I should wait few weeks before initiating interfile process.
I have given my biometrics in 2007 while filing I-485. Will USCIS send appointment for Biometrics again ?

It should be okay. I sent to my attorney as well as my HR. I do not see any issues as long as it is just GC copy.
My attorney asked me to send a copy of my GC to make sure the info is correctly printed. Is it ok send it to them?

My husband I-140 receipt notice has a wrong receipt date, instead of june 20 it has july 20 receipt date, the rest of the forms like I-485,Ap has the right receipt date, since he filed for labor substitution receipt date is critical since the deadline was july 16, what should we do anyone has the same situation pls help:confused:

one does not have to advertise for H1, might be they are advertisement is for filing your Labor application for GC.

I work for Employer A (who holds my H1) and I have an approved I-140 from Employer B, I-485 pending. Am due for H1B renewal this Dec, can I use my I-140 Approval (done from Employer B) to get 3 year extension when Employer A applies ?
