I count myself as one of the lucky ones as I already have a GC for the last two years and enjoy working in the US. However, my company has offered me a position in Europe for three years and I was wondering how this would affect my green card status. Can I put it on "hold"? If so, is it easy. Any feedback would be appreciated.

Guys, I need ur suggestion and experiences on my typical situation
I am in the process of going full time with my client.
I have my I-485 Filed in July 2007 & have EAD & AP
I am not in a position to use EAD as I got married after I filed for I-485. I have to stay on H1B to maintain my wife's H4 status.
my Client's Attorney is filing for H1B transfer and is suggesting that I can use EAD to start working as soon as he files for H1B transfer.
My understanding is I will loose H1 status if I use EAD, hence H4 will be invalid.
Was anybody in a similar situation ?
I don't want to take a risk by using EAD and my wife loosing H4 status.
Please advice

My story:
In my 2 work exp.letters submitted to CIS, I break down the number of months I was working with company A with 2 different positions and stated my duties & responsibilities. I started as an electrical technician from 06/'07 - 01/'98 (7mos.) and move to Sales Engineer position from 02/'98 - 09/'98 (7mos.) so that a total of 14 mos. CIS only counted the electrical technician experience since my labor application position is electrical technician. However, the position of sales engineer, also entails the work of an electrical technician. meaning sales works is an added duties for the technicain job.
Moreover, my second letter, company B with a job title of Technical Trainee was totally disregarded. Where in fact, my work is actualy training a would be
"electrical technician". Now I just need to find ways to justify that to CIS. I dont know how to start though...could anybody help me here????

Does anyone know how slow/fast/better is the Counsular Processing back in India if you ever become eligible to do that?

Don't go for it. It may be fast but you are working with too many variables that may go wrong. I went back home last year for CP and suddenly I became a victim of retrogression. I missed my cutoff date by two days. Then I had to wait for about 3 months to get my H1 stamp. I was lucky that I didn't lose my job here.

I am applying for Citizenship after completing 4 years and 9 months as a Permanent Resident in US.
Can any one please let me know as what is the processing time to get the Citizenship after I apply?
Also I have planned to move to a different State after I apply for Citizenship.
Please let me know whether it fine to move to a different address after applying for Citizenship? Else is this move not advisable?
Does this address change delay my Citizenship processing time?

Bottomline - if you are considering converting your LC case from TR to RIR, then your employer must send an email to DOL by Jan 20th and complete recrutiment process by April 1 ( or else case will be closed without recourse to appeal).

Hi,
I got H1-B petition (I-797) approved in 2008 but due to recession, I couldn't appear to consulate office. I did not get a chance to work in US for that employer so I don't have any pay stubs for that employer.
The petition is approved till 2011. And now I am planing to either appear for visa stamping or transfering I-797 to any other sponser.
My queries are -
A-Appearing for Visa stamping now after long time is right option or is there any chance of rejection?
B-Since My current employer is not able to employ me there,I want to transfer my I-797. Can It be possible? How much risk is there? If it can be done that what is the process of that please?
C-Since petition is valid till 2011, If I get stamped this year Oct / 2010 what will be duration of visa?
D-Any sponsrs list ?

Therefore, we recommend that EAD and AP renewals be filed 4 months prior to the expiration date, the earliest date USCIS will accept renewal applications. For EAD applications that have been pending for more than 90 days, an interim EAD card can be issued. Please contact our office for assistance with expedite procedures for your pending I-765 or I-131 application if your current work authorization is about to expire or if you have an emergent need to travel.

Hi ,
I Am planning to apply for my 10th Year H-1B Extension with the same employer.
My last H-1B was in 2007. I looked on doleta.gov The Prevailing Wage
in 2007 for the same job and same location as I am right now at
Level 3 was 57000.00, Now in 2010 it is 76000.
I talked to my Employer about this, he says he cannot raise my salary that much.
My Question is
1. When I applied for Foreign Labor Cert On-line does the
Prevailing Wage has to be most recent even in case of H-1B Extension ?
2. Is is ok If I go to Level-2 Instead of Level-3, will it considered as
change in Employment ?
3. The Prevailing Wage for 2008 for the same job and same location
as I am right now at is 66000. Should I Try to Apply for labor
cert referencing 2008 Prevailing Wage. ?
4. What are my options ?

Company A is willing to give me pre-approved labor. They are willing to file for my I-140 & I-485. They don't expect me to join with them now or immediately after I140 approval. Taking this situation into consideration,
* Do Company A should show the profit equivalent to salary in labor approval, as my case is future employment (Ability to pay)?
* I will for EAD, AP at the same time. Assuming I get EAD in 1 month(Hypothetical), Can I go and work for any employer other than company A, using this EAD?
* If yes, Is there a time restriction, before which I can't join in company B with this EAD?
