Hi,
I'm in H1b since March 2006 and it Expired in March 2009. Got extension Until Sept 2009 Only (as per RFE and client information).
( I'm about to deliver a baby in Oct 2009, so I need to be in the country atleast until Dec 2009)
1) If my further extension were to be denied (touch wood), say that decision was made by USCIS in Nov 2009,
Can I do COS ( change of status) to F2 or B2 visitor once I came to know about the denial?
or
Do I need to initiate a COS when the case is pending?
or
Do I need to initiate a COS when I have a valid status, say in Aug 2009 itself?
2) Assuming, I do COS successfully from H1b to F1 ( say in Oct 2009)
Then, in Feb 2010 would I be able to get back to H1 again with the same or different employer? without needing to wait for Apr 2010 quota to open?
3) Also, when a H1b is denied does it mean that the person has to wait to get into another cap? or
can they still apply for H1b year round as they are already counted in Cap sometime before?

No replies. So dropping idea of getting Business Credit Cards - perhaps it is not important at this stage.
Yes, I did get a business checkin card. Credit card, I guess, I can get only when the EIN number develops some history. Do you already have a business checking card?

hello,
Unfortunately a person with a pending form I-130 is not eligible to receive a work authorization. I-130 itself does not give you the legal authority to USCIS to issue a work permit. It is possible to get a work authorization if such a person has a pending I-485 (Adjustment of status) or is in other valid immigration status that would allow him / her to get work authorization.

Two friends of mine were in the same situation.
In both cases dependent children were approved first, then primary applicant
(in one case in a 6 month after his dependent)

For adjustee's AP gives permission to travel out-in. I think it should be ok to travel (you can subscribe to case updates and you'll know the case status)

Where to send the communication for AC21 to Texas Service Center? Has anybody used the email pilot?

I joined new job using EAD, didn't invoke AC21, my 140 was approved and I filed 485 in July2007.
There was a RFE for geographical discrepancy explanation and EVL from 140 filed employer or EVL from new employer if changed jobs on 04/29/2009.
(Changed address using AR11 after filing 485)
RFE on 485 on 04/29/2009
LUD on 140 on 05/01/2009
USCIS received EVL from new employer with AC21 - on 05/11/2009
LUD on 485 on 05/13/2009
LUD on 485 on 05/14/2009
Don't know whether they are soft LUD or Hard LUD.
Couple of questions, Is LUD on 140 normal when there is a RFE on 485?
Continuous LUD's on 485 normal?
can some one answer ...

Forget about justice. There is only business. The logic is very simple:
Current Situation: You target some perceived very deep pockets customers and try to sell yourself to them, but now you realize that they are just some idiots;
What are the alternatives: You can continue to push/educate these idoits, or try to sell your self to somebody else. You may make less profit up front, but if you truely have something, you might be able to make more out of it in the long run;
What if everything fails: No matter how good your product is, if you are unable to sell it, regardless if it is because your stupidity or your clients/potential clients' stupidity, as long as you didn't captalize it, your product worth nothing.
The bottom line: when a business fails, nobody thinks/cares about how good your product is, on the contray, everything thinks you are an idoit that makes a product that doesn't sell.
What you can do at least: Wake up and forget about justice, there is none.

Congratulations IV!! We have reached the 4000 member mark. While this is definetly a milestone, like TO_BE_OR_NOT_TO_BE and ragz4u pointed out, we have a lot more potential...
Now that being said, there is a difference between 'giving' vs 'taking'.. In the last couple of weeks we have had 100's of people register to become members, and yet whenever IV volunteers ask for contribution, less that 1% of the new people come to contribute.. That is a TAKER mentality..
Logiclife had started a thread (http://immigrationvoice.org/forum/showthread.php?t=895)that clearly explains why you should contribute.. we have about 2800 members that are yet to contribute... Folks, While a contribution of a 100$ is not a big deal, even if we contribute 50$ (to start with) and 50% of the 2800 people contribute we would have an additional $70,000. This should not be a big deal..
