I have a question; my girlfriend came to the US with a tourist visa in 2002 (now her visa is expired), so now I guess she is an ilegal alien, my question is: Is there anyway she can become a legal resident?

Me (as primary) and my wife are July 2007 filers and have our EAD and AP till end of 2010. I also have my H1b approved till 2012 but not stamped yet. My wife currently is in AOS status (comp didn't file for her H4 ext when they applied for my 7th yr H1b ext) but she has not used her EAD. We are planning to travel India next month and get our passport stamped (H1b for myself and H4 for my wife). I've couple of questions
1) Can someone confirm getting H4 for my wife will be treated as abandoning her I-485 because she is currently in AOS status? I don't think so but just want to confirm
2) In form DS156 for my wife what should I answer to this question "Has anyone ever filed an Immigrant Visa Petition on your behalf ?" or to be specific I-485 is treated as immigrant visa petition or I-140 is (in which case answer to this question will be no as her gc is applied as dependent)?

This may have been discussed here before also. But here is my situation-
I am on H1 and have applied for I-140. My wife (on H4) has applied for admissions in a couple of universities. Now, the simple rule is to get F1 visa so that you can do RA/TA during your course. Here are my questions-
1. Will my I-140 will effect her chances of getting F1?
2. How diffcult would it be to get F1 generally? Any tips or suggestions for us?
2. If she applies for F1 (but still she is on H4), can she travel to India? Or will it be too risky to travel then?
3. If she gets F1, do you think it is still risky to travel to India as she will have to get it stamped there? (Coz of my immigration application)

I have couple of questions regarding AC21 process.
1. AC21 does not have any tracking number. Then what does USCIS does with the AC21 package? Is it placed under a separate heap of AC21 files?
2. Does IO ever comes to know that you have applied an AC21 unless he issues RFE to check on your current employment?
3. The AC21 is never attached to your 485 application, as there is no tracking on AC21, right?
4. If you applied for an AC21 and Io issues RFE for current employment, do you need to send a copy of AC21 at that time to assert that you indeed informed USCIS?

1. I was on H1B with company A from Januray 2003 to January 2008.
2. I am on L1A with company A from February 2008 which is valid till December 2010 (my 7 year limit on L1A ends by December 2010).
3. My Labor is applied in October, 2009 by company B.
If my labor is approved or labor pending for 1 year, can I reactivate my old H1B with company B and start working with them.
Please advise. Mr. Dhoni

I think this rule got changed now. We have to wait for EAD until it is issued. Now we cant go to their office after 90 days for getting EAD

If you new H1 is approved with new employer (for 1 year or 3 years) and if the 140 is revoked AFTER your new H1 is approved, then it wont affect your H1 and it will be valid thru its term.
But if your old 140 is revoked, you will have to get new labor and new 140 going on before your new H1 expires.

Refugees from Sudan have a tough time with USCIS, let alone people from other nations. Refugees from Sudan have a tough time. Period. It is sad, and we should do what we can to help those less fortunate than us. Again, period. No ifs and buts about it. But is this the right forum, or even the right website?
There is plenty of clutter on these forums.. (And frustratingly, it has spiked a lot in the last week or so). Please do not add to it.

My I140 has recently approved on Aug,7th but the attorney and employer has already sent the withdraw letter to USCIS to cancel I-140 petition last month in July.But as they sent the cancellation letter to USCIS so is this possible if they sent the letter again to them not to withdraw or cancel I-140As right now I am in Canada,so I request them not to cancel I-140 and plz. do the consular processing for my case as I-140 is approved,so can someone advice me what will be the best thing,any advice will be appreciated.
