Hi: Need some inputs from the excperts in this group on using the priority dates from a different I140 filing.
Have the following 2 cases filed for the same person.
PD - Nov 2004 - EB3 - Labor Approved - I140 Filed
PD - Oct/Nov 2005 - EB2 - Labor Approved - I140 Approved
If we file I485 based on the I140 approved for EB2 case [which has a later PD], can we still send an update to USCIS later regarding Nov 2005 PD and use that PD once the I140 from the EB3 filing is approved? What's the best way to use the highest EB category and oldest PD in this case?
Thanks,
Sirisha

I've been a devoted fan of Adobe products for years - particularly Acrobat - and I'm happy to honor Adobe's CEO Shantanu Narayen. The Indian-born Narayen has a familiar story - he came to the US to pursue an advanced degree and then he was recruited by a tech company to stay. He began his career at Apple and then co-founded Pictra, a company that was one of the first involved with photo sharing over the Internet. He joined Adobe in 1998 and in 2005, at the age of 41, was promoted to his current position at the top of...

If a person is on dependant visa (H4) and applies for green card with their spouse's green card application, can they apply for H1 as well?
Thanks,

Can this status change be done without leaving the country? Can you please tell me what are the steps involved. I understand this may have been asked before. Can you point me to an old thread?

I was on F-1 when I applied for I-485 (my wife was the primary applicant). My I-20 expired 6 months back, and I'm working on EAD. I'm planning to travel to India and use my AP for return. Will that be fine ?
What about my I-94 expiry ? I still have a 2 yr old I-94 on my passport, marked F-1/D-S.

the old thread was deleted by someone (I hope by mistake or by automatic s.ware - since I don't know why anyone would do that - everyone has a family).
This is my last post and thread on this subject and I have even updated my profile (since some gave me red for this in the last thread .. I hope they do contribute too ..even a small amount like $20 goes a long way).
you can send a money order if you are concerned about sending a check.

Hi,
I'm in H1b since March 2006 and it Expired in March 2009. Got extension Until Sept 2009 Only (as per RFE and client information).
( I'm about to deliver a baby in Oct 2009, so I need to be in the country atleast until Dec 2009)
1) If my further extension were to be denied (touch wood), say that decision was made by USCIS in Nov 2009,
Can I do COS ( change of status) to F2 or B2 visitor once I came to know about the denial?
or
Do I need to initiate a COS when the case is pending?
or
Do I need to initiate a COS when I have a valid status, say in Aug 2009 itself?
2) Assuming, I do COS successfully from H1b to F1 ( say in Oct 2009)
Then, in Feb 2010 would I be able to get back to H1 again with the same or different employer? without needing to wait for Apr 2010 quota to open?
3) Also, when a H1b is denied does it mean that the person has to wait to get into another cap? or
can they still apply for H1b year round as they are already counted in Cap sometime before?

Hi,
I am in US in L1 Blanket visa and is expiring on November 26th 2009.
I am planning to go back to India for renewal.
Suggest me the best option is to extend the status in US or to travel back to India for visa renewal.

Hi,
Gurus - I have few questions and I need your help:
1. My EAD/AP expires in June/July '08. Can I apply for their renewal now?
2. Will there be a finger-printing requirement for the renewal? We had finger print in June 2007 when we applied 485/765/131 together?
3. Is it better to efile or paper file?
4. I will be in India from April to June this year. I have an AP valid till end June. Can I file for EAD/AP renewal and leave for India in April. Is there any risk? I can still use my current AP to enter when I come in early June, right?
Thanks so much.

From Lynn Sweet at the Chicago Tribune: Rep. Luis Gutierrez (D-Ill.) is among the small group of members of Congress meeting with President Obama Thursday afternoon to discuss immigration reform. Don't get your hopes up if you are tracking the issue. The meeting is happening, Chief of Staff Rahm Emanuel (D-Ill.) said Thursday morning at a Christian Science Monitor breakfast, because "the votes aren't there." Rahm's management rule: When you have the votes, you don't need a meeting.

Good news. The U.S. Citizenship and Immigration Service (USCIS) recently issued guidance on the new H-1B amendment that limits Troubled Asset Relief Program (TARP) recipients ability to hire H-1B workers. The USCIS confirmed that the new H-1B amendment does not apply to H-1B extensions for current employees with the same employer.
"EAWA does not apply to H-1B petitions seeking to change the status of a
beneficiary already working for the employer in another work-authorized
category. It also does not apply to H-1B petitions seeking an extension
of stay for a current employee with the same employer."

I have this thought. We start a letter campaign sending letters to all the house members: 1) To get them aware of Legal immigration and 2) To put our case fwd.
I feel it will be very effective as the flower campaign. Atleast most of us can participate in it, less expensive, less time consuming. And we can see why we wouldn't they respond to the bulk of mail they are getting every day.
I know we did letters through email etc. But i think sending through post will be different and they will be obligated to respond.
I do not know whether this is a good idea. so please dont rush at me.:)

Hey Glus,
I was hoping when you reply back to these people with the attorney's information you can request them to contribute to IV.
