Hi,
I have been granted an asylum last year in July. I sent my I-485 to adjust my status this year on August 24th with the fee waiver form (sending proof of food stamp eligibility and supporting documents.)
Today is October 2nd(its been almost 40 days) and I have not received a document receipt from USCIS (we are a family of 3 and non of us has received anything in regards to this matter)
Please let me know what actions should I take or should i wait?! Is it possible to not get a receipt and just receive the finger print notice in the next few months?! (I just checked texas service center's processing times, and it says they are at March 28th,2010 now)

With its members gathered in her office, she told the House's "Progressive Caucus" that she would vote against the war funding bill, but that she also had no choice but to facilitate its passage. Funds were running out for the troops, and she had promised to protect them. The Memorial Day break loomed, and without the money President Bush would have a week to hammer her party for taking a vacation while the Pentagon scrambled to keep its soldiers fed.
Was she agonized over the situation? Sure, said Rep. Maurice D. Hinchey (D-N.Y.), who attended the meeting. But "we all feel that way," he added. "I feel that way, too. Are we going to just walk away now, or are we going to continue this process, to keep the pressure on?"
Yesterday's vote to fund the war through September was a historical rarity: the passage of a bill opposed by the speaker of the House and a majority of the speaker's party.
Two years ago to the day, then-Speaker J. Dennis Hastert (R-Ill.) violated the "Hastert rule" -- that only bills supported by a majority of the majority can come up -- by bringing up legislation to allow federal funding for stem cell research. The majority of the Republican majority opposed the law. He voted against it, but he knew it would never become law over President Bush's signature.
Over his objections and the opposition of most Republicans, Hastert did allow passage of campaign finance reform in 2002, but only because a petition drive was about to force the bill to the floor. The North American Free Trade Agreement passed in 1993, over the objections of most Democrats, who were then in the majority. But NAFTA did have the support of then-Speaker Thomas S. Foley (D-Wash.), as well as the Democratic president, Bill Clinton.
In contrast, the Iraq funding bill was not only opposed by the majority of House Democrats, it was also ardently opposed by the speaker and even the lawmaker who drafted it, Appropriations Committee Chairman David R. Obey (D-Wis.). And it is destined to become law.
"We don't relish bringing a package to the floor that we're not going to vote for," Obey conceded before last night's vote.
Pelosi's agonized decision put her in the company of Foley, who in 1991 brought to the floor the resolution authorizing the Persian Gulf War and then voted against it, and Thomas Brackett Reed, a speaker in the 1890s who voted against the annexation of Hawaii, and then against the Spanish-American War, but allowed both to go forward.
"To have the chairman and the speaker vote against a bill like this, I've never heard of it," Hastert said.
But while protesters outside the Capitol condemned what they saw as a capitulation, Democrats inside were remarkably understanding of their speaker's contortions.
Party leaders jury-rigged the votes yesterday to give all Democrats something to brag about. A parliamentary vote to bring the Iraq funding legislation to the floor included language demanding a showdown vote in September over further funding. A second vote allowed Democrats to vote in favor of funds for Gulf Coast hurricane recovery, agricultural drought relief and children's health insurance. Hi All,
I sent h1b extension application to california center on june 22nd and my application is still not approved. My current visa was valid until July 30th. I need to travel to India on Dec 10th due to urgent reasons . Please suggest what should I do
1. Can I travel while my extension is pending?
2. Can I raise a service request to speed up the processing?
2. or Upgrading to PP is the only option?
I do have EAD and advance parole through my husband's GC application. If I use parole for travel what happens to my H1b visa and GC application filed through my employer. My visa will still be valid or not?
Please help...

I am in my 5th yr of H1, and my H1 status will expire next year on Nov 1, 2011.
My I140 filed and is with the appeal Office since jan 2009, with no decision.
I wanted to know what my options are with the current scenario.
� What are the chances of this appeal being approved? ( it was denied based on 5 yrs of education vs 6 years)
� If the appeal is denied, can I transfer the Labor to an EB3, with the same Priority Date?
� Since there is no decision yet, do I have to file another Labor cert ( a new one) for H1 extension.
� How can I still maintain this priority date?
� If I have to file a new Labor cert, can that be done in EB2,with a different job title?

My company and lawyer refuse to talk to me or email me back.
I sent my completed package to the lawyer 2 weeks back, and I have not heard back from him.
The initial draft needs to be sent back by the lawyer for signatures and then the file can go out.
How do I hadle the situation?
sounds like your lawyer is getting 'instructions' from your company. I would just try to talk to your employer and work out a solution.

I fulfill the requirements of AC 21 (485 pending for more then 2 years and I 140 approved long back)
My current project is not my employer's client. There is one middle vendor from which I have got this project.
Now, I have heard that many consulting companies make you sign a contract which states that any client you find becomes their client and therefore forbidding you to join them directly. As we usually dont see papers while signing I am not sure if I did sign any such thing. My question is, if my employer sues me on this clause, does it hamper my I-485 processing? Any input in this context would be highly appreciated.Tension is killing me

My F1 visa expires on July 6 of 2011. However, I have an I-20 that permits me to stay in the United States until August 31st of 2012. The reason for this is that I came here as a master's student, but transferred to a PhD program. This is my second I-20.
I have plans to leave for India in May of 2011 and stay until end June 2011. Will it be necessary for me to apply for an F1 Visa extension? Technically I'll be back by July 6, but will it be problematic to get back without a renewed visa because there are only a few days remaining on the old visa? my company have applied for H1-B & H4 extension for myself and my wife. My wife now is looking to go for work and has got an offer from a company. The company will be doing a premium processing of my wife's H1-B and it is expected to be approved in 2 weeks. my wife has already held H1 status before, so she doesn't fall undr the cap. If my wife's H4 comes thru later, what status will she hold?

I'm concurrently filing 140 and 485 at NSC (my application shd be out in 2-3 days). I've obtained a waiver and my J-1 expires next year Aug 2008. What do you guys feel that if this much time is enough to obtain the decision regarding those two applications. I'll be getting my and wife's EAD in 3 months. Should I used EAD after my J-1 expries or else I move to H-1 a month before it expires. Presently my wife is working in a private company (j-2 EAD). My lawyer discouraged me by saying that my applicaation could be rejected as J-1 is non-immigrant intent visa?? Please reply...

Is premium processing available for EAD?

I checked current EAD form and dont see any reference to premium processing being available

My Wife is on H4/AOS.
Her H4 is going to expire in September and she is planning to travel soon.
She has AP and EAD but never used. I am on H1 and used AC21.
My questions are..
1) Can she go to home country and get her H4 stamped and return on H4?
2) Apply AP and return on AP?
3) Assume...If she returns on AP...and show valid EAD while entering at POE....
But by that time her H4 expires.... In this scenario...do we still need to apply H4 extension after entering US?
4) Who supposed to apply H4? Is it employer or H1 holder can also apply H4?
